Conditions of sales

Please be aware that there are different Terms and Conditions for the unpaid Freewebsite services, that you agreed to, when creating your homepage. In the following, we will mention ourselves by “Freewebsite”, “Freewebsite Service” and “Us” and you as a user by “You” and “User”.
The conditions of sale are for the paying customers at Freewebsite and to get access to Premium and Website shop products you have to approve the sales conditions and accept them. You do that by ticking the box with the Conditions of Sale that shows in the buying process.  The contract will then govern all further relations between you and Freewebsite service.

Freewebsite services that you can buy
There are to primary areas of services you can buy and add to your free website. You can either choose to buy products in our Website shop, which includes a lot of different products to make your own website even more unique. These products will be lump sum benefits.
On the other hand you also have the possibility to become a Premium user. With a Premium agreement you can get your own domain name and/or delete the link to freewebsite service.  You need a Premium 2 agreement, to be allowed to delete the link to freewebsite service. There are different types of Premium agreements with different price levels and service details. You can have an overview on the website under the Premium overview.

Prices and currencies
Currencies and prices are indicated on the website for the different services and domain names.
You have the possibility to pay in Danish Kroner, Euro, English Pound and US Dollars. The currency conversion is updated regularly and numbers are rounded up.
All prices are inclusive of Danish VAT of 25%.
Prices can be changed from with an 8 working days written notice by e-mail You will simultaneously be able to see the changes on your website after they are changed. We there recommend to keep yourself updated as a Premium customer, before you continue for a new contract period.  
Price changes to the different Premium account types will only take place for the new contract period, giving you the new price level before deciding to continue a new contract period.

Setting up a Premium Account
When you create your Premium account, you will get a written confirmation of your agreement via email.
After a purchase via the website shop you will get an email confirming the sale via electronic payment.

Delivery, Access and Right of return
According to the paragraph 18 of the Consumer Law, stk. 6, jk. Stk. 4 (“The Danish law of consumer contracts”),  the delivery of the service starts immediately after the ordering of the service so at this point you cannot refuse or cancel the service. Please see further below how to end or cancel your agreement.
As soon as you confirm a purchase, Freewebsite incurs costs to deal with it. These costs will have to be covered by the user/buyer, also in case you want to cancel your purchase.
When you buy a Premium account, the sale is confirmed as soon as you agree to the Conditions of Sale when buying online. Your Premium account will be created within 48 working hours after the confirmation with the exception of the sale of an international domain or in case a transfer of domain is missing your approval.

Duration
Duration of the agreement: You can freely choose between contracts for 3, 6 or 12 months. You will prepay for the duration of the contract and only after the first chosen contract period finishes, can you end your contract. Furthermore you need to inform us about you want to cancel the contract, latest 8 working days before the start date of the new contract period.    
During the running of the contract you can choose to change the type of account you have. In case you want a more expensive Premium account, please contact us. In case you want a cheaper Premium account, you will not get refunded however.

End of contract / Cancellation
On your invoice we will mention the date for the next invoicing. Latest 8 working days prior to that date you need to send an email to team@freewebsite-service.com to cancel or end your agreement. You will need to provide the same information in your email as you did when you opened the account.
In case your contract is ended by Freewebsite you get a refund of the remaining payment for the duration that you contract should have had, except in case of breach of contract, Terms and Conditions or illegal use of the site by the user, which typically will be our reason to a termination of a website.
Note however that you are able to move from a Premium user to a free user and your website will be placed at www.freewebsite-service.com/yourname and will be unaffected by the ending of a contract. You have to contact us, if you want to make that change

Domains
It is possible to have up to two domains on a Premium account. You cannot cancel a domain when you ordered it as each domain is unique. When ordering a domain you agree to comply to the law regarding third parties rights, copyright, commercial rights and in general do not legally misuse the site and domain. In case Freewebsite registers the domain for you, you will be asked to accept to legal requirements when the domain rights are transferred to you.
Registering or moving a domain: When buying or moving an international domain, can take up to 5 working days for the registration to come through. For .dk domains up to 2 working days. If you want to move a .com domain you have to get a EPP code from your previous provider.

How to pay
Website shop: you can choose to pay with following credit cards: Mastercard, VISA or American Express
Premium Account: Transfer to our Bank, with the Reg. number 3346 and account number 3513090005.  These details will also be in your invoice. We are working to have also the credit card payment possibility, ready for your next payment.
In case of missing payment, we will send a reminder 3 working days after the last payment date and with a continuing missing payment, we will send a 14 Euro/100 Dkr penalty, 8 working days after the date of the reminder. In case of a continuing missing payment you Premium account is suspended.  You can still keep your free account. We will though emphasize, that you still are required to pay according to the contract between you and Freewebsite.

Disclaimer and limitation of liability
Freewebsite cannot be held responsible for any damage or loss you may occur such as the use or missing possibility to have access to your account, whatever the reason may be (such as when we are maintaining/updating the server). Damages and loss include direct and indirect loss, loss of uptime, emotional damages, loss of data and reinstalling of data and damages to hardware.
In case Freewebsite would be held responsible by court for your use, is the maximum extend of the liability the paid Premium account price for the valid contract period or the price of the Shop products. As written more in depth in the Terms and Conditions, the responsibility for the content on your website at freewebsite, is your own responsibility solely.
We would like to specify here that the services bought online are for your own use and should not be handed out (such as passing on of password), sold onto other parties or redistributed by any way.
All sale made at Freewebsite, including Premium and Website Shop, we can only be committed to owe the value of the sale, if you gets upheld and take further actions, by a given reason. We can therefore not we responsible for a larger amount than that, If you become unsatisfied with a buy and gets upheld legally.
Overall Freewebsite accepts no liability for the content and material made by users and we hereby expressly disassociates us from this content, especially it is illegal content. It is of cause impossible for Freewebsite to constantly check the posted content by users, but if we become aware of content that breach the law or is harmful, such content will be removed immediately and reported. This is also described more in the Terms and Conditions and  Privacy Policy.

Governing Law and courts
Danish Law and Courts are ruling for all legal terms, Conditions of sale (comprising the contract between Freewebsite and the customer), Terms of conditions and Privacy Policy if it is possible and not to a judge to decide and it don’t necessary have to depend on location, with the exception of the FN law of sale.
