Subscription terms


Be aware that different terms and conditions applies for unpaid Freewebsite services that you have agreed to and confirmed when you created your website.

1. Introduction

In the following, we name ourselves "Freewebsite", "Freewebsite-service.com" and "us" and you as "you", "user", "customer" and "subscriber".

If you enter into a deal with Freewebsite, these Subscription Terms shall be effective unless agreed otherwise. The contract will then manage all further relations between you and Freewebsite.

The agreement is between you and Freewebsite-service.com - by Freewebsite ApS.


2. Services, prices and currencies

Freewebsite-service.com is an online tool for building websites. You can buy domains "Premium" and related services, as well as additional features "Products" for the website. Read more about setting up "Premium" and domains in later sections.

Features and prices are indicated for each product, domains and other paid services. All prices on domains and subscriptions are including 25% VAT.

You have the option to pay in Danish Kroner, Euro and U.S. Dollars. Currency conversion is updated regularly and numbers are not rounded up.

Prices are subject to change from an 8 working days written notice via e-mail. You will also be able to see the changes at our website after they have been made.


3. Subscription duration

A subscription runs for 1 month. The subscription can be cancelled at any time from your account in the administration and payment will be stopped when the month of your subscription period has expired. If you for example started your subscription on the 1st of the month and terminate it on the 12th of a month, your subscription will expire on the first of the following month and there will not be charged additional payments on your card.

Note that the purchased products will be deleted immediately after subscription expiration date and you will lose all related content. When downgrading a Premium subscription to one without a domain you will lose such as Google rankings. For complete stop of Premium subscription you will get advertising on your website.

Freewebsite may, at any time, terminate a subscription with 30 days notice if the subscription type ceases to exist. In such cases, you will get paid any difference for the remaining period in relation to the prepayment.

Freewebsite may be justified in its sole discretion and without giving any reason to cancel a subscription upon 30 days written notice sent by mail to your provided e-mail address. In such cases, you will get paid any difference for the remaining period in relation to the prepayment, unless the notice of the subscription is due to violation of Freewebsite's terms and conditions or other offensive or illegal content.

After the end of the subscription, you will still have a free website, unless the termination is due to violation of our terms. If so, you will no longer be able to access and/or retrieve data added or created through our services.


4. Delivery

When you pay by credit card you will be enrolled in Freewebsite-service.com's payment service, which means your subscription will automatically renew each month. This prevents your domain and other products from automatically ceasing to exist/work. You are responsible for updating your current e-mail address and credit card information at your Freewebsite-service.com account.


4.a. Delivery of Premium

After your payment of Premium Basic, Pro or Business we receive the order. Your website will then be on the domain within 48 hours (on weekdays) after your domain has been registered on/moved to our server.

When purchasing Premium Business it includes Business SEO and Business design which are developed according to your own schedule and in the processes that are common to the development of web design and SEO. Therefore, we are not tied to any definite delivery date for these products. We are bound to deliver a satisfactory product within the hours which the prices allow. Additional functionality is a completely different product to be agreed on an individual basis.

When you purchase "Premium Ad free" the advertising will be removed from your website automatically, immediately after your payment.


4.b. Delivery of features

When you order a feature, it is automatically released on your website immediately after payment.


4.c. Late delivery

When setting up your domain (Premium website) we can run into delays. In the unlikely event that we cannot set up your domain within 48 hours (on weekdays) from your domain is available on our server, we promise you a free feature. We cannot be held financially liable for late delivery, however, we will refund your prepaid subscription if delivery does not take place. This is not related to Right of withdrawal, which you can read about in the next section.


5. Right of withdrawal

These rules are valid under Danish law. Under the rules of consumer law § 18, you have a right of withdrawal. The cancellation period is 14 days and runs from the day you signed the agreement(completed the purchase). Under the rules of consumer law §18, you are entitled to information, including the right of withdrawal and the service ordered. The withdrawal period will not begin, until you have received this information in writing (eg., On paper or e-mail). However, the cancellation period must expire no later than 3 months after the day you signed the agreement.

By accepting these terms you agree that the provision of the service starts after payment of the services ordered, and that after this time you cannot undo the purchase according to Consumer law § 18 pcs.4.
See section 6 for details on upgrading, downgrading and cancellation of subscriptions.


6. Change subscription

Note that these terms are based on the launch of a payment module expected at the end of 2013.

Until then, a subscription runs for 12 months and you must cancel at least 8 days before the expiration date via e-mail. You will pay in advance for the duration of the contract, and you can only end your contract after the initial contract period ends. During the course of the subscription period, you can choose to change the type of subscription. If you want to upgrade, downgrade or cancel please contact us. Note that if you want a cheaper premium account, you will not receive a refund for prepaid subscription.


6.a Upgrade

You can always upgrade your subscription to a subscription that is more expensive. In such cases, you will have to complete a new order in which you should note the increase in the subscription price and the full new price. The renewal of your subscription will then run from the date you make the new order. If you for example upgrade your subscription the 10th of a month, your subscription will then be renewed the 10th of each month. Therefore, it can be optimal for you to upgrade a few days before your subscription is automatically renewed.


6.b Downgrade

You can also easily downgrade your premium subscription for a cheaper package. You do this from your account in the administration. Downgrading to a cheaper package is the same as an upgrade. After you complete the order of a cheaper package, we will receive your order and you get a receipt. Save the receipt as mentioned in point 7.d.

When downgrading your subscription, we will immediately make the changes in settings for your new subscription. Even if your former subscription expires at a later date, the downgrade begins from the moment you make the new order. If you for example downgrade your subscription on the 6th in a month, your subscription will then be renewed the 6th of each month. Therefore, it can be optimal for you to downgrade a few days before your subscription is automatically renewed.

When purchasing Premium Business, which includes manually performed work of great value, you cannot downgrade until after one year from your order date. If you want to stop your Premium Business subscription within the first year, you must terminate and delete the website.


6.c Termination

You can easily cancel your subscription. Termination of the Premium subscription can be done from your account in the administration, go to downgrade and select 'Downgrade to free website'.
Once you have approved this action, we will receive an E-mail about closing your subscription. The payment is stopped immediately and your domain is taken down when your subscription period expires. If you want your domain taken down immediately please contact us.

You CANNOT cancel your subscription by deleting your website, it will not register in our system and stop payments. If you want to delete your website, remember FIRST to stop your subscription(s)

Stopping payment for features happens with a single click from your account. Note that the features will cease to function immediately after this action, they will not work until your subscription period expires. Also note that you will lose everything you have done with this feature!


6.d Cancellation

In case your contract is terminated by Freewebsite, you will be refunded the remaining amount of your subscription period duration, except in cases of breach of contract, breach of our terms or illegal use of the website by the user.


7. Payment

Subscriber must pay subscription in advance, it is only possible to pay by credit card. The following cards are accepted: Visa, Visa Electron, Mastercard(incl. Mastercard debet) and Dankort(Danish credit card). At a later point we might add more international cards.

If a payment is not completed for any reason, you will receive an E-mail asking you to change your credit card information on your account. If this is not done within 20 working days, your services will be stopped.

Until we get payment module the following applies: In the event of non-payment, we will send a reminder 3 days after the last payment date and with a continued non-payment, we will send a 20 USD administration fee, 8 days after the date of the reminder. In the event of continued non-payment, your Premium account will be suspended. You can still keep your free account. We must emphasize, however, that you are still required to pay under the contract between you and Freewebsite.


7.a Criteria for drawing on the credit card

We and our payment partner protect your information using SSL encryption. SSL stands for Secure Sockets Layer and is a function, which means that all information sent between buyer and seller is encrypted. To make payment by credit card as safe as possible, alle information is sent with SSL encryption (Secure Sockets Layer). This means that information goes through a secure connection and that your card details cannot be read by outsiders.

The customer enters his card no., expiration date and year and the three-digit security code.

Subscription terms will be accepted and the request is forwarded.

Customer card information will then be stored at ePay and give Freewebsite message of the payment claim.

Withdrawal is done when an employee from Freewebsite electronically requests via ePay for execution of payment.

Freewebsite will never be in possession of the customer's credit card information. Your card details are safe and secure with our payment partner(ePay).


7.b Renewing and deleting credit card details

You can edit your credit card details from your account in the administration. To delete your card details, you must first cancel your subscription at Freewebsite and then delete your data under your account in the administration. You can easily have a free website with us after you have terminated your subscription and deleted your card details.

If you delete your card details while you have a subscription with us, your next payment does not go through. As described in Section 5.e you will have 20 working days to update your credit card information before your services are terminated.


7.c Cardholder liability

Your subscription purchase is binding from the moment the payment is completed and you have got a receipt. The cardholder is required to pay the full amount for the entire first subscription period and subsequent subscription withdrawals, unless the subscription in the meantime has been terminated pursuant to the rules of termination in Section 6.c.


7.d Receipt

At the end of the checkout process, you will receive a receipt by e-mail. You can also download your receipt as a PDF on the receipt page after successful payment. You should keep this receipt as it is your proof of your purchase. The receipt corresponds to the content of the documentation Freewebsite stores on the agreement, but Freewebsite does not store information about your order in a way so that you can request a copy of the receipt later on.

ATTENTION! If you do not receive your receipt email within 24 hours after purchase, please contact Freewebsite Support at team@freewebsite-service.com.


8. Offers

Freewebsite can put services on offer for limited time periods. This offer is valid only for the number of months specified in the offer, then the normal price will automatically be withdrawn from your credit card instead


9. Domain

In connection with the purchase of a Premium subscription it is possible to buy one or two domains to attach to your website.

You cannot cancel a domain once you have ordered it, as each domain is unique. This also applies to errors in registration of domains, such as. spelling or typing errors.
When ordering a domain, you agree to abide by the law of third party rights, copyright, commercial rights and generally to not abuse the website and/or domain. In the event that Freewebsite registers the domain for you, you will be required to accept the legal requirements when the domain is transferred to you.


9.a Registration or transfer of a domain

When you buy or transfer an international domain, it can take up to 5 business days before the transfer comes through. If you want to move a .com domain, you need to get an EPP code from your previous provider.

10. Privacy

When you have a subscription with Freewebsite we save the information you provide. Personal information is used to complete the purchase, for which the information is collected. Information is also used internally in Freewebsite to conduct market research and develop targeted products. On Freewebsite-service.com we also use cookies. Currently we only use cookies to save your login information, so you do not have to type it every time. Read more in our Privacy Policy.

Credit card details are not stored on our server. They are kept safe with our payment partner (ePay).


11. Changing Subscription terms and prices

Freewebsite has the right to change these terms without notice. However, changes in business conditions in relation to existing subscription contracts apply only at renewal or extension of the subscription agreement.

Freewebsite reserves the right to change the prices of the different subscription types. Any price adjustment will take place at the beginning of a new subscription period, so you have the option to cancel your subscription. Freewebsite may also choose to collect payments for a service or a product that was previously free.
You are responsible for being aware of the current terms and prices shown at www.freewebsite-service.com.


12. Disclaimer and Limitation of Liability

Freewebsite cannot be held responsible for any damages or losses that may occur such as inability to access your account or website, whatever the cause may be. Damage and losses include, but are not limited to, direct or consequential losses, loss of uptime, customers, system errors, data and content revenue and utility of purchased services, subscriptions and features, as well as emotional damage.
The above applies regardless of whether the system is attacked, goes down, or if the Company is sold, goes bankrupt, or chooses to close. It will therefore not be possible to recover the money from purchased Features, Premium subscriptions or other services.

In the case that Freewebsite would be held accountable by law, the maximum amount/liability will be the value of your remaining subscription period for Premium, Features or other services.

As written in more depth in our Terms and Conditions, the responsibilty for the content of your website is yours alone. Of all sales, including Premium subscriptions, features and other services, we can only be required to owe the value of the remaining subscription period if you are legally upheld and we can therefore never be liable for an amount greater than that. Any damage and loss is outside our responsibilities, as described above.

Overall Freewebsite assumes no responsibility for the content and material created and uploaded by users, and we hereby expressly distance ourselves from this content. It is of course impossible for Freewebsite to constantly check the content published by users, but if we become aware of content that violates the law or is harmful, such content will be removed immediately and reported.


13. Transfer

Freewebsite are eligible for full or partial transfer of your subscription as well as its rights and obligations under these Terms to a third party.


14. Governing Law and Courts

Danish law and the courts are ruling for all legal terms including Terms and conditions, Subscription terms(consisting of the contract between Freewebsite and customer) and Privacy Policy; if possible and if the court does not depend on location, with the exception of the UN purchasing law.

Any dispute will be resolved by Sø- og handelsretten(the Maritime and Commercial Court) in Copenhagen, Denmark.
